The NDIS Code of Conduct explained: the 7 elements

The NDIS Code of Conduct sets out how every NDIS provider and worker must behave, whether you are registered or not. It has applied across the whole sector since 2019, and a written policy plus signed worker acknowledgements are among the first things an auditor or the Commission will look for. Here is each of the seven elements in plain English.

Who the NDIS Code of Conduct applies to

The Code applies to all NDIS providers and the people they employ or engage, including contractors and volunteers. It applies whether or not you are a registered provider. Registered providers also have to show how they uphold it through policies, induction and supervision.

The 7 elements of the Code

NDIS workers and providers must:

  1. Act with respect for individual rights to freedom of expression, self-determination and decision-making.
  2. Respect the privacy of people with disability.
  3. Provide supports and services in a safe and competent manner, with care and skill.
  4. Act with integrity, honesty and transparency.
  5. Promptly take steps to raise and act on concerns about matters that may affect the quality and safety of supports.
  6. Take all reasonable steps to prevent and respond to all forms of violence against, and exploitation, neglect and abuse of, people with disability.
  7. Take all reasonable steps to prevent and respond to sexual misconduct.

What it looks like in practice

Auditors want to see the Code translated into everyday behaviour: getting consent, respecting choice, keeping information private, raising concerns early, and never ignoring signs of harm. Your policy should spell out what each element means for your workers and what to do when something goes wrong.

How to evidence it for an audit

Hold a current Code of Conduct policy, induct every worker on it, and keep a signed acknowledgement on each worker's file. That signed page is one of the cheapest and most powerful pieces of audit evidence you can hold.
